What debts are not discharged by bankruptcy?

Not all debts are discharged. In general, liens (such as mortgages and security interests in cars) are non-dis-chargeable as are some other types of obligations including:

(1) Federal, state and local tax claims (subject to specific time rules)

(2) Customs duties

(3) Spousal support

(4) Child support

(5) Most student loans

(6) Secured debts

(7) Fines and penalties imposed by government agencies

(8) Debts incurred due to false statements made with the intent to deceive

(9) Fraud committed in a fiduciary capacity, such as embezzlement or larceny

(10) Punitive damage claims for "willful and malicious" acts

(11) Debts not listed on the forms and schedules filed with the Court

(12) Drunk driving obligations

A non-dis-chargeable debt is one that will survive the bankruptcy proceeding. The debtor still has the obligation to pay this debt; the creditor has every right to collect.

I was a bankruptcy counselor, so to say it easily, any debt tied to the government, you will have to pay. Some states have different exemptions. Also, any debts, medical bills or criminal penalities cause by driving under the influence of anything are not dischargable and you will have to pay. Bankruptcy is meant for credit card debt and any assets you are willing to give up.

If your bankruptcy case is under Chapter 13, you won't be discharged from the following types of debts.

* Child support and alimony (domestic support obligations)
* Student loans
* Fines and restitution
* Certain taxes, such as withholding taxes if you had employees, or taxes connected to fraudulent tax returns or tax evasion
* Debts incurred through fraud
* Debts for fraud while you were acting in a fiduciary capacity, or for embezzlement or larceny
* Debts for willful and malicious injury
* Judgments in wrongful death or personal injury cases arising from your intoxication
* Unscheduled debts
* Debts incurred after filing your case, which weren't included in your Chapter 13 plan
* Debts that are nondischargeable under other laws, for example amounts owed for certain health education programs
* Interest owed on nondischargeable debts

Your credit report should not indicate that you have an unpaid debt. You should dispute the credit report and you may be able to prosecute the creditor for breach of the landfill. You should contact your lawyer.

In case of lacking description of debt we have to face a legal case, that is not suitable so always go with the laws governing activities and don't give a chance to others put the finger on your works.
