Can a husband and wife run a business as a sole proprietor or do they need to be a partnership?

They do not have to be a partnership but you are going to have to have one be the owner and one be the employee good luck with your negotiations:)

Be careful about how you do your tax returns (divide your income tax liability); there's a test case in the High Courts on at the moment...
